Terms of Service

The app's end user licence agreement (EULA) is included in these Terms. Read the licence terms.

These Terms of Service are a legal agreement between you and Roadsy, the Ontario-based developer identified in the applicable app-store listing. They govern the Roadsy Android app, roadsy.app, and related services. The app requires you to accept these Terms. If you do not agree, do not use Roadsy.

Eligibility and international availability

Roadsy is operated from Ontario, Canada and may be made available in multiple countries and regions. Availability, features, units, and language support may vary. You may use Roadsy only where and in a manner permitted by applicable law. Roadsy may restrict availability where reasonably required by law, sanctions, export controls, security requirements, or service limitations.

You may use the app only if you have the legal capacity to enter into this agreement and meet any minimum-age requirements that apply to you. Roadsy does not verify a driver’s licence, residence, citizenship, or age. Do not use an account after Roadsy has suspended or terminated it.

If you use Roadsy for an organization, you confirm that you have authority to bind that organization. Consumer rights that cannot lawfully be waived continue to apply.

The service and beta status

Roadsy is a local-first driving journal. Core functions can store trips on your device. An optional account can provide private backup and Community features. Some functions are experimental, limited by device compatibility, controlled by release switches, or unavailable during pre-release testing. A description of a planned feature is not a promise that it will be released.

Automatic detection is optional, depends on supported Android permissions and device conditions, and does not guarantee that every drive will be recognized, started, or completed. Roadsy may update its scoring methods, confidence rules, retention limits, maps, interfaces, and supported features. A material change to a paid service will be handled with the notice and remedies required by applicable law.

Drive first, app second

Do not hold, configure, read, or interact with Roadsy while driving. Set up and mount your device before moving, obey traffic laws and road conditions, and stop somewhere lawful and safe before reviewing the app. You remain solely responsible for controlling the vehicle and deciding whether it is safe to drive.

Roadsy is not navigation, an emergency service, a collision-warning system, professional driving instruction, legal or insurance advice, or proof that anyone is safe or unsafe. GPS, sensors, maps, speed estimates, detected events, confidence values, and scores can be delayed, incomplete, or wrong. Never rely on Roadsy to identify a speed limit, hazard, emergency, or lawful driving action.

Accounts and security

You may record locally without an account. If you create an account, provide accurate information, keep your sign-in credentials and device secure, and promptly notify hello@roadsy.app of suspected unauthorized access. You are responsible for activity through your account to the extent permitted by law.

The country you choose for an account is self-declared and used for account administration, legal notices, service availability, and regional defaults. It is not proof of residence, citizenship, or current physical location. Roadsy does not require a province, territory, or street address for account setup and does not infer or preselect your country from Google, another authentication provider, GPS, an IP address, or your device locale.

After authentication through Google, email and password, or another supported provider, you must select a country and explicitly accept the current Terms before account features are enabled. You can change the country later. Roadsy privately records the accepted Terms version and server acceptance time as described in the Privacy Policy.

Roadsy may require email verification or recent authentication for sensitive actions. You may not transfer, sell, rent, or share an account in a way that defeats security or eligibility controls.

Licence and intellectual property

Roadsy grants you a personal, limited, revocable, non-exclusive, non-transferable licence to use the service as intended for lawful personal use. Roadsy software, branding, visual design, and original content are protected by intellectual-property laws. Except where applicable law or an open-source licence permits it, you may not copy, modify, distribute, sell, lease, bypass protections for, or reverse engineer Roadsy.

These Terms do not transfer ownership of Roadsy technology, branding, or content. Third-party and open-source materials remain subject to their own licences.

Community content and sharing

You retain ownership of text, profile material, and other content you submit to Community. You grant Roadsy a worldwide, non-exclusive, royalty-free licence to host, reproduce, format, transmit, display, and make that content available to the audience you select, and to secure and moderate the service. This licence lasts only as long as needed for those purposes, subject to reasonable backup, legal, security, and moderation retention. It does not give Roadsy permission to publish your private trip records or use them for research.

You must have the rights and permissions needed for content you submit. Do not publish unlawful, infringing, abusive, deceptive, threatening, discriminatory, privacy-invasive, or dangerous content. Do not include another person’s personal information, an exact address, or sensitive route details without authority. Even audience-limited recipients can copy or redistribute what you share.

Roadsy may limit distribution, remove content, preserve relevant evidence, or restrict accounts when reasonably necessary to enforce these Terms, respond to reports, protect people or the service, or comply with law. Where appropriate, you may request a review at hello@roadsy.app.

Acceptable use

You may not use Roadsy to break the law; stalk, harass, threaten, discriminate against, or track another person without authority; interfere with a vehicle or emergency response; gain unauthorized access; probe or defeat security; scrape or overload the service; transmit malicious code; impersonate another person; manipulate service records deceptively; infringe rights; or help anyone do these things.

You may not use Roadsy data to make unlawful or unfair decisions about another person. Roadsy is not designed for insurance underwriting, employment discipline, fleet enforcement, credit, or legal adjudication.

Privacy

The Roadsy Privacy Policy explains what information Roadsy handles, why it is used, where it is processed, how long it is retained, and the choices available to you. Privacy controls, personal-data export, moderation reporting, and account deletion are not conditioned on a paid subscription.

Usage analytics and privacy-filtered crash reporting are automatically enabled after you accept the current Terms and complete app setup. You can turn either service off separately in Settings. Roadsy limits the information sent to the categories described in the Privacy Policy and does not intentionally include exact routes, coordinates, Roadsy account IDs, trip IDs, tokens, or free-form text. Analytics collection is suspended when its control is off. A Crashlytics opt-out takes full effect the next time the app starts, and Roadsy requests deletion of reports still waiting on the device once collection is disabled. Turning either control off does not automatically delete information already received by the provider.

Subscriptions and purchases

Roadsy offers an optional, no-card 14-day automatic-detection preview after an eligible first trip. The preview is not a Google Play subscription or introductory trial, does not renew, and ends automatically.

Roadsy Pro is offered through optional monthly and annual auto-renewing Google Play subscriptions when a live store offering is available. The purchase screen shows the localized price, currency, billing period, included features, and automatic-renewal terms before you confirm. Roadsy does not offer a Google Play introductory trial. Store terms presented at purchase also apply. Store confirmation alone does not unlock Pro. Roadsy activates access only after the purchase is verified against the signed-in Roadsy account.

A subscription bought through Google Play is billed and renewed by Google Play until cancelled. You can restore access, or manage or cancel the subscription through Google Play. Cancellation normally stops future renewal while access continues to the end of the paid period, unless Google Play or applicable law provides otherwise. Refunds, pending payments, grace periods, account holds, and expiry are governed by Google Play, Roadsy’s verification state, and applicable law. Deleting a Roadsy account does not cancel a Google Play subscription, and cancelling a subscription does not delete a Roadsy account or local trips.

Subscription ownership remains with the Roadsy account that made the purchase. A restore from another account can be blocked and directed to account recovery. Roadsy support may transfer ownership only after verifying both Roadsy accounts and store ownership, requiring recent authentication, revoking access from the former account, and recording the change. No account can receive more than one support transfer in any 90-day period.

Third-party services and Google Maps

Roadsy relies on service providers for accounts, private backup, notifications, diagnostics, maps, website delivery, analytics, email updates, and published articles. A provider may change or interrupt its service. Links to third-party sites do not mean that Roadsy controls or endorses their content or practices.

Roadsy includes Google Maps features and content. Your use of Google Maps features and content is subject to the then-current Google Maps End User Additional Terms of Service and the Google Privacy Policy.

Availability, changes, and communications

Roadsy may maintain, update, limit, suspend, or discontinue all or part of the service. Roadsy does not guarantee uninterrupted availability, compatibility with every device, or preservation of information beyond the retention rules described in the Privacy Policy. Keep an independent export of information you need.

Roadsy may send service, security, legal, account, active-drive, drive-result, backup, weekly-recap, moderation, and subscription communications where needed to provide the service. Product tips and Pro offers are optional, can be turned off, and follow the consent and unsubscribe requirements that apply.

Suspension, termination, and account deletion

You may stop using Roadsy at any time. You may request account deletion in the app or through the account-deletion page. A deletion request immediately hides Community activity and schedules the cloud account and associated data for permanent deletion after a 30-day cancellation period. Local trips remain on the device until you delete them, clear the app’s data, or uninstall the app.

Roadsy may suspend or terminate access when reasonably necessary for a serious or repeated breach, unlawful conduct, a security threat, non-payment, provider or legal requirements, or protection of users and the service. Where practical and lawful, Roadsy will provide notice and an opportunity to appeal. Provisions that by their nature should survive termination, including ownership, disclaimers, liability limits, and dispute terms, will survive.

Disclaimers

To the maximum extent permitted by law, Roadsy is provided “as is” and “as available.” Roadsy disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free scoring, and data availability. Roadsy does not warrant that a score, event, route, map, speed, report, or other output is complete or suitable for insurance, employment, fleet discipline, a legal proceeding, or an emergency decision.

Nothing in these Terms excludes a warranty, condition, remedy, or consumer right that applicable law does not permit Roadsy to exclude.

Limitation of liability

To the maximum extent permitted by law, Roadsy and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profits, opportunities, goodwill, or data, arising from Roadsy or these Terms, even if advised that such loss was possible.

To the maximum extent permitted by law, Roadsy’s total liability for all claims arising from the service or these Terms will not exceed the greater of the amount you paid Roadsy for the service during the 12 months before the event giving rise to the claim and CAD $100. These exclusions and limits do not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded or limited.

Governing law and disputes

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada. This choice does not deprive you of mandatory consumer, privacy, or jurisdiction rights that apply where you habitually reside. Nothing in these Terms limits any right that cannot lawfully be waived. These Terms do not require arbitration.

Before starting a formal claim, you and Roadsy should try in good faith to resolve the issue by contacting hello@roadsy.app. This request does not shorten or suspend a legal limitation period.

General terms

If a provision of these Terms is unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign your account or these Terms without Roadsy’s consent. Roadsy may assign these Terms as part of a lawful reorganization, financing, or transfer of the service, subject to applicable notice and consumer rights.

Changes and contact

Roadsy may update these Terms prospectively. A new effective date will be shown, and material changes will receive reasonable notice. The app will request renewed acceptance when the nature of a change or applicable law requires it. Changes do not retroactively reduce rights that already accrued.
